Louisiana construction laws are ideal for design-build projects.
The Louisiana State Uniform Construction Code adopts public policy provisions relative to maintaining uniform standards. Louisiana construction law creates conditions for the certification of building enforcement officials, establishes requirements for "uniform performance standards" and encourages "the use of construction materials of the greatest durability."
Construction Contracts
Louisiana state-registered professionals use construction contracts for those areas of a project that require a design, an alteration, some repair and/or maintenance of buildings, highways and other types of structures, including water and sewer lines.
The Indemnity Clause
The indemnity clause is a standard provision within all types of contracts, including agreements for construction projects. Louisiana state law governs provisions within the construction contract that require forms of "motor carrier transportation" and permits provisions that require that require third-parties to provide proof of liability insurance (See Reference 2).
Design-Build
The Louisiana Code permits design-build projects for hurricane recovery plans. According to construction law, a "design-builder is contractually responsible for delivering the project design and construction" and may sublet responsibilities.
State Licensing
The Louisiana Code requires the state to license professionals working on a design-build project. For example, state agencies license engineering and surveying firms through the Louisiana Professional Engineering and Land Surveying Board. They license architectural firms through the Louisiana Board of Architectural Examiners; lastly, they license contractors through the State Licensing Board for Contractors.
