Register An Export Business

The U.S. population represents less than one-quarter of the world, so exporting your product, service or technology could significantly increase your market potential. According to U.S. law, export businesses are registered like any domestic business; however, the business must register each product or service for export. The U.S. Department of Commerce provides detailed export controls to protect U.S. interests.


Instructions


1. Determine if your product or service is strictly defense-related or if it also has commercial applications. Products and services strictly for defense are not regulated by the Department of Commerce, but by the Department of State. Most export business deals with "dual use" or strictly commercial products. If you aren't sure, you should file a commodity jurisdiction request with the Department of State to determine how your product or service will be regulated.


2. Find your product or service in the Commerce Control List, available online, and identify its Export Classification Control Number (ECCN). The Commerce Control List groups exports into ten technology categories, such as nuclear materials and electronics. Within each technology grouping, products are classified by product type. Most products and services do not belong to any of these technology groupings; if your product cannot be found on the list, it uses ECCN EAR99.


3. Make a note of the "reasons for control" in the ECCN entry for your product in the Commerce Control List. Based on which part of the ECCN is appropriate for your product, the reason for control may or may not apply. Be sure to read the section in the ECCN entry on controls and the country chart.


4. Look up any country to which you want to export in the Commerce Country Chart. If there is an X in the column applicable to your product, you will need to get a specific export license, unless you can qualify for an exemption. Additional information on governments of concern to the United States or under international sanction is provided by the Department of Commerce.


5. Submit your application for export licenses required based on your products and where you are exporting by using the Simplified Network Application Process Redesign (SNAP-R) or submitting form BIS-748P.
